Terms of Use

By accessing and using Sinhas Swiss ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Use, please do not use the Platform.

2.1 Eligibility

You must be at least 18 years old to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement.

2.2 Account Registration

To access certain features of the Platform, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.1 Listing Accuracy

Property owners and agents are responsible for ensuring that all information provided in their listings is accurate, complete, and up-to-date. This includes property descriptions, pricing, availability, photographs, and contact information.

3.2 Prohibited Content

You may not post listings that:

• Contain false, misleading, or fraudulent information
• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Contain offensive, discriminatory, or inappropriate content
• Include spam, malware, or malicious code

3.3 Listing Removal

We reserve the right to remove any listing that violates these Terms of Use or is deemed inappropriate at our sole discretion, without prior notice.

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any portion of the Platform
• Interfere with or disrupt the Platform or servers or networks connected to the Platform
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Collect or store personal data about other users without their consent
• Use automated systems or software to extract data from the Platform (screen scraping)

5.1 Platform Role

Sinhas Swiss acts as a platform connecting property owners/agents with potential tenants. We are not a party to any rental agreements or transactions between users. All rental agreements are made directly between property owners/agents and tenants.

5.2 No Brokerage Fees

For rental properties, we do not charge brokerage fees to tenants. However, property owners/agents may have their own fee structures, which should be clearly disclosed in the listing.

5.3 User Responsibility

Users are solely responsible for conducting their own due diligence before entering into any rental agreement. This includes verifying property details, reviewing rental contracts, and ensuring compliance with Swiss rental laws.

The Platform and its original content, features, and functionality are owned by Sinhas Swiss and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Platform without our prior written permission.

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We make no representations or warranties regarding the accuracy, reliability, or completeness of any content on the Platform, including property listings.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SINHAS SWISS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We are not responsible for any disputes, damages, or losses arising from transactions between users or from the use of information obtained through the Platform.

You agree to indemnify, defend, and hold harmless Sinhas Swiss and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your violation of any rights of another.

We reserve the right to modify these Terms of Use at any time. We will notify users of any material changes by posting the new Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms of Use.

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Switzerland.
